Terms of Service

Probate Made Easy

Effective Date: 1st September 2024 Welcome to Probate Made Easy. These Terms of Service (“Terms”) govern your use of our services, including our website and all probate-related services we provide. By engaging with our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Definitions

“We,” “Us,” and “Our”: Refer to Probate Made Easy, including our employees, consultants, and any third parties acting on our behalf.

“You” and “Your”: Refers to the person or entity using our services.

“Services”: Refers to all probate-related services offered by Probate Made Easy, including but not limited to estate administration, legal documentation, and funeral liaison services

2. Engagement of Services

Provide accurate, complete, and up-to-date information as required for the probate process. Cooperate with us in promptly providing necessary documentation, signatures, and instructions.

Pay the agreed-upon fixed fee and additional disbursement costs (as outlined in Section 6).Allow us to act on your behalf in dealings with relevant authorities, institutions, and other entities to complete the probate process.

3. Scope of Services

Probate Made Easy offers fixed-fee probate services to manage the legal and administrative tasks involved in probate, including estate administration, communication with relevant authorities, and handling of legal documentation.

We do not provide legal representation or financial advice, and our services are not a substitute for the services provided by solicitors or accountants unless specifically agreed in writing.

4. Payment Terms

Disbursement Costs: Any third-party disbursement costs (as outlined above) will be passed on to you, and we will always seek your approval before incurring such costs.

Additional Charges: Any additional fees for extra services or unforeseen complexities will be discussed and agreed upon before they are charged.

Payment Schedule: Payment terms and schedules will be outlined in the service agreement. In general, fees may be payable either upfront or in installments, depending on the terms agreed upon.

Late Payments: In the event of late payment, we reserve the right to suspend or terminate our services until the outstanding amounts are paid.

5. Fixed Fee & Additional Services

Probate Made Easy charges a fixed fee for standard probate services. This fee covers:

  • Full administration of the probate process, including gathering relevant documentation, submitting legal paperwork, and communication with necessary parties.

  • A dedicated consultant to assist you throughout the process.

Additional services, such as liaising with undertakers or handling funeral arrangements, may incur additional charges. We will always inform you of these charges before proceeding with any additional services.

6. Disbursement Costs

In addition to our fixed fee, certain disbursement costs are not included in our service fee. Disbursement costs are third-party fees that we may need to pay on your behalf during the probate process. These may include (but are not limited to):

  • The formal probate registration fee (which is payable to the court or probate registry).

  • Fees for obtaining copies of the death certificate.

  • Fees for property valuation services.

  • Other government or institutional charges directly related to the probate process.

7. Your Responsibilities

You are responsible for:
• Ensuring all provided information and documents are accurate and complete.
• Notifying us promptly of any changes in circumstances that may affect the probate process.
• Cooperating with us in a timely manner to facilitate the completion of the probate process.
Failure to provide accurate information or cooperate as required may delay the probate process or result in additional fees.

8. Termination of Services

You may terminate our services at any time by providing written notice. However, you will remain responsible for any services already provided, costs incurred, or disbursement fees up to the point of termination.
We may also terminate or suspend our services if:
• You fail to comply with these Terms.
• Required payments are not made.
• We determine that continuing the service is no longer feasible due to legal, practical, or ethical reasons..

9. Limitation of Liability

While we strive to provide high-quality services, Probate Made Easy shall not be held liable for:
• Any loss or damage resulting from your failure to provide accurate or timely information.
• Delays or failure in providing services due to circumstances beyond our control (e.g., third-party delays, legal complexities).
• Indirect, incidental, or consequential damages, including but not limited to loss of inheritance, emotional distress, or reputational harm.
Our total liability for any claims arising from our services is limited to the amount paid by you for the services in question

10. Intellectual Property

All content, materials, and information provided on our website or in connection with our services (including logos, text, images, and documents) are the intellectual property of Probate Made Easy unless otherwise stated. You may not reproduce, distribute, or otherwise use our intellectual property without our express written consent.

11. Confidentiality

We respect your privacy and the confidentiality of all information provided to us during the probate process. Any personal or estate-related information you provide will be handled in accordance with our Privacy Policy.v
